What You Can—and Can’t—Ask a Seller in a Buyer Beware State Like Alabama

If you're considering buying a home in Alabama, there's one key legal phrase you need to understand up front:
“Caveat Emptor.” It’s Latin for “Let the buyer beware.”

Sounds dramatic, right? But it has real implications that every buyer should know—especially when you’re about to make one of the biggest investments of your life.


⚠️ What “Buyer Beware” Means in Alabama

In Alabama, real estate law puts the burden of discovery on the buyer. That means sellers aren’t legally required to tell you about every issue with a property. In many cases, if you don’t ask, they don’t have to tell.

The exceptions? Sellers must disclose:

  • Known lead-based paint hazards (federal law)

  • Material defects that present safety risks (in some cases)

  • Any direct questions they answer must be truthful—if not, that’s considered misrepresentation


❓ What You Should Be Asking

In a buyer beware state, it’s your responsibility to dig deeper. Here are key questions I recommend every buyer ask—either directly or through your agent:

  • How old is the roof, HVAC, and water heater?

  • Have there been any past plumbing or electrical issues?

  • Has the home ever flooded, even minor flooding?

  • Have there been any insurance claims on the property?

  • Were permits pulled for any renovations or additions?

  • Are there any shared driveways, easements, or encroachments?

  • Is the home in a flood zone or hurricane evacuation area?

Asking these questions may not guarantee full disclosure, but it opens the door for conversation—and helps protect you from surprises after closing.


🔎 Don’t Skip the Inspections

Even with the right questions, don’t rely on the seller’s word alone.

Always:

  • Hire a licensed home inspector you trust

  • Add optional inspections if needed (roof, septic, HVAC, mold, etc.)

  • Request and review seller repair receipts or warranties

  • Research zoning and property use (especially for land or rural areas)
